Do I Have to Submit a COA Report?

If your facility falls under one of the five types of establishments listed below, you must submit a COA report in the government of Mexico's SEMARNAT website by June 30th of each year.

Qualifying establishments:

  1. Fixed sources of federal jurisdiction set out in Article 111 Bis, paragraph 2, of the Regulations of the General Law on Ecological Balance and Environmental Protection (LGEEPA) - see infographic to the right
  2. Facilities that discharge wastewater into national waters (seas, rivers, lagoons, etc.)
  3. Large hazardous waste generators (10 tons or more per year) OR small or micro generators that have emitted 10 tons or more over the span of two years
  4. Hazardous waste management service companies working in transportation, collection, and management (reuse, recycling, co-processing, incineration, disposal end, etc.)
  5. Companies in the energy, industry, transport, agricultural, waste, and commerce and services sectors, as set out in Articles 3 and 4 of the General Law on Climate Change on the National Registration of Climate Change Emissions (RENE), which emit 25,000 tons or more of CO2 equivalent greenhouse gases (GHGs)

Air Emissions

Keep a complete and accurate model of GHGs and other pollutants (HAPS, VOCs, VHAPs, etc.) released (or controlled) by all processes and sources at your facility.

Wastewater Discharges

Input sampling data, lab analytical results, and discharge quantities (volume), the software calculates the discharge per chemical or per effluent parameter (temperature, pH, suspended, solids, etc.).

Hazardous Waste Records

Measure the total quantity shipped offsite for treatment for all waste streams in your facility, speciated by profile (known composition) or by quantity (unknown composition), based on your usage records, manifest data, and internal tracking logs.

What are NESHAPs?

National Emission Standards for Hazardous Air Pollutants (NESHAPs) were created as an extension of the CAA to monitor the amount of hazardous air pollutants (HAPs) from stationary sources—factories, refineries, boilers, power plants, etc.

What are MACT standards?
The percentage of air emissions that can be prevented is often limited by the current level of available technology. That's why the EPA developed Maximum Achievable Control Technology (MACT) standards: the EPA sets the emission levels being achieved by the top-performing sources in that industry (for similar source types) as the industry baseline, known as the "MACT floor". Sources must, at a minimum, achieve a level of emissions control (for that industry equivalent to the MACT floor.
How does the EPA enforce NESHAP/MACT standards?
In short, the EPA sets emission standards on an industry-, chemical-, or manufacturing process-specific basis. Owners and operators at industrial facilities must conduct initial performance tests on all sources to demonstrate compliance and, throughout their operation, monitor their operating parameters. In addition, sources may be required to install and operate continuous emission monitors.
What should I expect from an EPA inspection?

EPA auditors regularly conduct inspections on regulated facilities to evaluate compliance and identify and address excess emissions. Inspectors may engage in one or several of the following:

  • Interviewing facility personnel
  • Examining reports and records
  • Reviewing leak detection and repair methods and practices
  • Inspecting the processes that have emissions points subject to the standard sampling wastewater discharges, if applicable
